Terms of Use
Version dated
1. Purpose and acceptance
These terms of use (the “Terms of Use”) set out the rules for using the HypnoSelf app (app.hypnoself.app) and the hypnoself.app website, published by WAYNA, a French single-member limited liability company (EURL) with a share capital of EUR 100, registered with the Annecy Trade and Companies Register (RCS) under number 979 238 417, whose registered office is at 20 chemin des Combes, 74410 Saint-Eustache, France, VAT number FR35 979 238 417 (hereinafter “WAYNA” or “we”). Full contact details are given in the legal notice.
HypnoSelf is a digital wellbeing and personal development service. It generates, plays and tracks personalised self-hypnosis and affirmation sessions, written by an artificial intelligence from an introspective conversation with you. In the app, a session and its audio are called a “ritual”.
You accept these Terms of Use by ticking the box provided for that purpose when you create your account. This acceptance is time-stamped and kept as evidence (Articles 1127-1 and 1366 of the French Civil Code). Without acceptance, you cannot use the app.
The paid subscription and the free trial are also governed by the Terms of Sale. The processing of your data is described in the Privacy Policy. On matters of subscription, price, withdrawal and cancellation, the Terms of Sale prevail over these Terms of Use.
2. User account
Age. Registration is open only to people aged 16 or over, wherever they live. By creating an account, you declare that you are at least 16 years old; this declaration is time-stamped and kept. If we learn that an account has been created by a younger person, we delete it together with the associated data (Article 8 of the GDPR).
Login details. The account is created with an email address and a password. You undertake to provide an accurate address that you control: we send service emails to it (in particular the account confirmation, password reset, subscription confirmation, reminders relating to the trial and the subscription, and the cancellation confirmation; the full list is given in the Privacy Policy). Your account is personal. You keep your password to yourself and you notify us at contact@hypnoself.app if you believe a third party has accessed it.
Recovery key. When end-to-end encryption is enabled on your account (section 4), you are given a recovery key. Keep it in a safe place, outside the app. If you lose both your password and your recovery key, your encrypted content is permanently lost: we do not hold the key and are technically unable to restore it.
One trial per address. The free trial described in the Terms of Sale is granted only once per email address, including if you delete your account and then create a new one with the same address.
3. How the service works, compatibility and changes to the service
HypnoSelf is an installable web app (PWA). It works in a recent browser (Chrome, Safari, Firefox, Edge) on a computer, tablet and phone. There is no native app on the app stores. This section informs you, before you make any commitment, of the service’s functionality, compatibility and interoperability (Articles L111-1 and L221-5 of the French Consumer Code).
An internet connection is required to create an account, log in, talk with the assistant, create a session and synchronise your data between your devices. Audio that has already been generated can be listened to offline if your browser has cached it. Your hardware, your browser and your connection remain your responsibility.
You can export all of your data in JSON format from your profile. HypnoSelf does not connect to any other service and offers no interoperability with third-party applications.
We develop the app over time. We provide the updates needed to keep the service in conformity, including security updates, for the whole duration of your subscription (Article L224-25-25 of the French Consumer Code). If a change going beyond that maintenance were to reduce your access to the service or your use of it, we would inform you by email, sufficiently in advance, before it applies; you could then cancel free of charge within thirty days of that information or of the change, and the part of the paid period not yet provided would be refunded to you (Article L224-25-26 of the French Consumer Code). The legal guarantee of conformity and the remedies it gives you are detailed in the Terms of Sale.
4. End-to-end encryption (E2EE)
Your affirmations, the summaries of your conversations with the assistant and your audio are encrypted on your device (AES-256-GCM) before anything is sent to our servers. The encryption key is derived from your password; it is never transmitted and remains under your exclusive control. We cannot read this content. This encryption is one of the measures we take to protect your data by design and to keep it secure (Articles 25 and 32 of the GDPR).
This encryption does not cover everything, and you need to know this:
- the titles and themes of your sessions remain readable by our systems;
- if you enable the daily notification, the affirmation sent in the notification is transmitted unencrypted;
- the thread of your conversation with the assistant travels unencrypted while the exchange is taking place, because the model has to read it to reply to you; it is not kept, and only the summary you validate and the affirmations you keep are saved, encrypted (section 5);
- sessions created before encryption was enabled remain unencrypted until you encrypt them from Profile > Security.
The details are given in the Privacy Policy.
5. Artificial intelligence assistant
You are talking with an AI, not with a human. The introspective conversation, the affirmations and the session images are produced by an artificial intelligence system based on Google’s Gemini models. The interface signals this with the “AI Assistant” label (Article 50(1) of Regulation (EU) 2024/1689 on artificial intelligence). Nobody reads your conversations.
Content marked as generated. The affirmations, summaries and images created for you are AI-generated content. The images carry Google’s invisible SynthID watermark, which we keep as it is; in the export of your data, each affirmation carries the mention genere_par_ia: true (Article 50(2) of the same Regulation).
Limits. A language model produces a probable text, not a truth. The affirmations may be clumsy, repetitive or not right for you. You choose which ones you keep and you remain free not to listen to them. Nothing the assistant produces is medical, psychological or therapeutic advice (section 6).
No automated decision about you. The assistant makes no diagnosis and is not used for any decision producing legal effects or significantly affecting you (Article 22 of the GDPR).
Your health data and your consent. What you write during the conversation may reveal your emotional state or your mental health. We treat it as health data, only with your explicit consent, collected through a dedicated checkbox before your first conversation and logged with its date and the version of the text (Article 9(2)(a) of the GDPR). You can withdraw this consent at any time in Profile > Security: the conversation then becomes unavailable, and the sessions you have already created remain (Article 7(3) of the GDPR). The “Delete my conversations” button, in the same place, deletes the conversation summaries that are kept. What is transmitted to Google, from where and under which safeguards is described in the Privacy Policy.
Distress. If distress is expressed during the conversation, the assistant stops generating and refers you to the emergency numbers on the app’s Safety page. This response is automatic. The app is not an emergency service: if you are in danger, call the numbers given in section 6.
6. Wellbeing and safety notice
HypnoSelf is a wellbeing and personal development tool. It is not a medical device within the meaning of Regulation (EU) 2017/745, nor a therapy, nor a healthcare service. HypnoSelf does not diagnose, treat, cure or prevent any disease or mental health condition. It is no substitute for a consultation with a doctor, a psychologist or a psychiatrist. If you are undergoing treatment or receiving care, do not stop it on the strength of what you hear in the app.
If you have a psychological, psychiatric or neurological condition, a heart condition, epilepsy or any condition that deep relaxation could affect, seek the advice of a healthcare professional before using the app.
Never listen to a session while driving, operating machinery or doing anything that requires your full attention. Settle down in a safe place.
If you are in distress or facing an emergency
If you are in immediate danger, call for help rather than writing in the app: it is not an emergency service, and nobody reads your conversations with the AI.
France: 3114, emotional distress and suicide prevention, free, confidential, 24 hours a day, 7 days a week; 15, SAMU, medical emergencies; 112, all emergencies, the European emergency number.
Europe: 112. United Kingdom and Ireland: 116 123. United States and Canada: 988. Australia: 13 11 14.
The app shows these numbers in its language on its Safety page. In another country, contact your local emergency services.
7. Licence to use and intellectual property
What we grant you. WAYNA grants you, for the lifetime of your account, a personal, non-exclusive, non-transferable and revocable licence to use the app, in compliance with these Terms of Use, for your personal, non-commercial use. This licence covers free access (first ritual, trial) as well as paid access. It transfers no ownership right in the app to you and ends with your account, or earlier in the event of a breach (section 9).
What remains WAYNA’s. The app, its code, its design, its own texts and sounds, the HypnoSelf trademark, the instructions given to the AI models (“prompts”) and the session template are protected by copyright and trademark law (Articles L111-1, L122-4 and L713-2 of the French Intellectual Property Code). You may not copy, modify, decompile or resell them, or extract elements from them, except where the law expressly allows it (Article L122-6-1 of the French Intellectual Property Code).
What is yours. The affirmations, conversation summaries and audio created for you from your answers are yours. You may listen to them, export them and use them for your personal use, including after your subscription ends, for as long as your account contains them (section 9). WAYNA claims no rights in them and uses them for no purpose other than those described in the Privacy Policy.
8. Acceptable use
You undertake not to:
- use the app for illegal, fraudulent or harmful purposes, or to harm others;
- attempt to access, probe or compromise our systems or those of our service providers, or circumvent our security measures;
- circumvent the assistant’s limits or give it instructions intended to produce unlawful or dangerous content or content intended to cause harm;
- use automated means (bots, scripts) to access the service or extract its content;
- share your account with a third party, open several accounts to obtain several free trials, or resell access to the service;
- use the app to obtain or produce content of a medical, therapeutic or diagnostic nature, for yourself or for a third party.
9. Suspension, account deletion and inactivity
Suspension by WAYNA. In the event of a breach of these Terms of Use, we may suspend your access and then delete your account. Except in urgent cases (fraud, security breach, unlawful content, request from an authority), we first notify you by email, stating the breach, and give you a reasonable period to remedy it or reply to us (Articles 1224 to 1226 of the French Civil Code). If your account is deleted without any breach on your part, the unused part of the paid period is refunded to you.
Deletion by you. You can delete your account at any time from your profile. Deletion is immediate. All your data is erased, except what the law requires or allows us to keep without being able to identify you: (a) the evidence of your acceptance of the legal documents and of your consents, anonymised, for the defence of our rights in legal proceedings (Article 17(3)(e) of the GDPR); (b) a non-reversible fingerprint of your email address, which is used only to avoid granting the free trial twice and does not make it possible to recover the address; (c) the log of subscription events, without any account identifier; (d) your invoices and receipts held by our payment provider, kept for ten years (Article L123-22 of the French Commercial Code). The details are given in the Privacy Policy.
Effect on the subscription. Deleting your account stops a current trial and cancels a current subscription; the period already paid for is not refunded, except in the cases provided for by law and recalled in the Terms of Sale. If you only want to stop paying and keep your sessions until the end of the paid period, cancel the subscription instead of deleting the account: from Profile > Subscription, from the Cancel my subscription page or by email to contact@hypnoself.app.
Inactivity. If you have not logged in for one year after the end of your paid access, your rituals, audio, images and listening history are deleted; the account itself remains open. Founders’ Circle accounts and complimentary accounts are not affected. Remember to export your data beforehand.
10. Liability
What we owe you. We provide the service described in these Terms of Use and in the Terms of Sale with care and skill, and we are answerable for its conformity under the legal guarantee for digital services (Articles L224-25-12 et seq. of the French Consumer Code). We are liable for damage caused by a breach of our obligations, under the ordinary rules of law (Articles 1231-1 et seq. of the French Civil Code). Nothing in these Terms of Use limits or excludes our liability for fault, fraud or personal injury, or your legal guarantees (Articles L212-1 and R212-1 of the French Consumer Code).
Availability. We use our best efforts to keep the app accessible at all times. It may be interrupted for maintenance, updates or an incident at a service provider; we restore the service as quickly as possible. We are not liable for unavailability caused by force majeure (Article 1218 of the French Civil Code), by your hardware, your browser or your connection, or by use contrary to section 8.
Generated content and results. The content produced by the assistant is generated automatically from your answers, without human review, and is probabilistic by nature (section 5). We do not guarantee that a session will produce any particular result for your wellbeing: the effect of self-hypnosis and affirmations varies from person to person. You use the app with knowledge of the warnings in section 6.
Your content and your key. We cannot restore encrypted content whose key has been lost (section 2). We recommend that you export your data regularly from your profile.
11. Changes to the Terms of Use
We may change these Terms of Use to keep pace with changes to the service or to the law. Each version is dated, and the date appears at the top of the document.
A substantial change is presented to you in the app the next time you log in, and we ask you to accept it before continuing to use the service. You remain free to refuse it (Article R212-4 of the French Consumer Code): in that case, you can no longer use the app, and you can cancel your subscription under the conditions of the Terms of Sale or delete your account. If the refused change reduces your rights or your use of the service, cancellation is free of charge and the part of the paid period not yet provided is refunded to you. A change never applies retroactively to a period already paid for.
An editorial change (clarification, correction, formatting) applies without new acceptance; it does not reduce your rights.
12. Governing law, mandatory rights and disputes
These Terms of Use are governed by French law.
If you live in another country, this choice does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside (Article 6 of Regulation (EC) 593/2008, known as Rome I). Nothing in these Terms of Use limits the rights you have under the consumer law of your country, in the European Union or elsewhere (for example the Australian Consumer Law or Canadian provincial laws).
In the event of a disagreement, write to us first at contact@hypnoself.app: we reply within five working days and look for an amicable solution. You can then use a consumer mediator free of charge (Article L612-1 of the French Consumer Code), under the conditions given in the legal notice.
If the disagreement persists, you can bring the matter before the courts of your country of residence or the French courts, at your choice (Article 18 of Regulation (EU) 1215/2012, known as Brussels I bis); outside the European Union, your local law may give you access to your own courts, and nothing here prevents that. WAYNA can only bring proceedings against you before the courts of your country of residence.
These Terms of Use are written in French. Their English translation is provided as a courtesy; in the event of any discrepancy, the French version prevails, except where a mandatory provision of the law of your country of residence provides otherwise.
13. Affiliate links
Some pages of the app and the website (books, listening equipment) contain links to Amazon.fr. HypnoSelf takes part in the Amazon EU Associates Programme: as an Amazon Associate, HypnoSelf earns from qualifying purchases. These links are identified as such, no price is displayed, and the purchase is completed on Amazon’s website under Amazon’s own terms.
